Terms of sale

The conditions that apply to every purchase from Progarden Gear S.r.l. through this website. Sending an order means you accept them, so please read them first.

Last updated: 01 October 2026

1. Parties and scope

For the purposes of these terms: the Seller is Progarden Gear S.r.l., registered office Strada Toscana 14, Naples, Italy, VAT no. IT485949509; the Website is this site; the Buyer is whoever places an order on it; a Consumer is a Buyer acting for purposes unrelated to their trade, business or profession.

These terms apply to all sales made through the Website. They never reduce the protection that consumer law grants you in the country where you live: if a clause gives you less than the law, the law prevails.

2. Eligibility

Anyone with legal capacity to sign a binding contract may order, regardless of nationality or residence, as long as we deliver to the country selected in the order form.

3. Products, prices and stock

We describe every product as precisely as possible. Photos and videos are examples: the product you receive, and any free item included, may show minor differences depending on availability.

Prices include VAT where due and are expressed in the currency of the delivery country. Any shipping charge or cash-on-delivery fee is displayed before you confirm, so the final amount is never a surprise.

Products are sold while stocks last. If a product runs out after you have ordered it, we inform you promptly and refund any amount already paid. When only some items of a multi-product order are unavailable, this concerns those items only, and shipping costs may not be fully refunded.

If a product page shows a maximum shipping time longer than thirty days, that time applies to that product and you accept it by ordering.

4. Formation of the contract

  1. Sending the order form on the product page is your offer to purchase.
  2. We acknowledge it with an order receipt, which is not yet an acceptance.
  3. For cash on delivery orders, we phone you to confirm.
  4. When the goods are handed to the courier, we send the order confirmation: the contract is concluded at that point.

The receipt and the confirmation both summarise the products, the price, any shipping charge, your identification and billing data, the delivery address, the information on withdrawal and a link to these terms.

Before you receive the order confirmation you can cancel free of charge by writing to our support team. After delivery, the right of withdrawal described in section 9 applies.

5. Refusal or cancellation by the Seller

We may refuse or cancel an order, telling you by email, if:

  • the product is not available;
  • a price was published incorrectly by mistake — in that case we first ask you whether you want to buy at the correct price;
  • a promotion is misused, or one of the behaviours in section 12 occurs;
  • a bank reports the payment as fraudulent;
  • a cash on delivery order cannot be confirmed by phone within 48 hours;
  • a force majeure event continues. The order is first put on hold and, if the event lasts three months, cancelled automatically unless otherwise agreed.

Any sum already collected is refunded without delay. Your statutory rights are not affected.

6. Payment

We accept cash on delivery, credit and debit cards, Google Pay and Apple Pay. The methods offered depend on the delivery country; those not available cannot be chosen. With the exception of cash on delivery, payment is taken when the order is sent.

Card and wallet payments are processed by certified providers over encrypted connections. We never see your card details and never store them. If an order is cancelled, we immediately ask for the authorised amount to be released; the time it takes depends on your bank.

To protect cardholders we may request extra information or a document proving the card belongs to you. Without it, the sale may not go ahead.

7. Paying the courier

Payment in cash at the door is possible only where the order form offers it. The courier collects the full amount when handing you the parcel.

  • Once you have ordered, we ask you by phone to confirm. The call may come from a company that works for us, and is made to the number you entered.
  • An order we fail to confirm by phone within 48 hours can be cancelled automatically.
  • On the call you verify where the parcel goes, how much you will pay and how.
  • Some countries add a fee for cash collection; you see it while ordering, already in the total.
  • Please have the exact amount ready, as the courier may have no change.
  • You can cancel during the confirmation call or by telling our support team.

If a Buyer repeatedly refuses parcels without warning or a valid reason, we may stop accepting cash on delivery orders from that Buyer.

8. Delivery

The delivery estimate you see when ordering is indicative. Our obligation is to ship promptly and to deliver no later than thirty days after the contract is concluded, except for the longer times allowed by section 3. Parcels travel with an established courier, on working days, to the address you entered; delivery is considered made once the goods are at your disposal at that address.

Shipping costs, where due, are paid by the Buyer and shown before the order is sent. Shipping may be free above certain amounts or during promotions; any charge is always displayed in advance.

When the parcel cannot be handed over because nobody is in, it is stored at the courier’s depot. For 10 days you can arrange a new delivery through the link sent to you by email; a further 7 days are then allowed for collection, after which the parcel comes back to us and the contract ends.

When the parcel arrives, count the packages against the courier’s paperwork and look at the outer packaging. Any sign of damage or opening should be raised on the spot: either decline the parcel or add accepted subject to inspection next to your signature, then let us know quickly. This does not affect your right of withdrawal or the legal guarantee.

If force majeure, unavailability of carriers or other unforeseeable circumstances delay delivery, make it impossible or make it substantially more costly, we may deliver in several parts, postpone it, cancel it wholly or partly, or cancel the order as provided in section 5.

9. Withdrawal and returns

Consumers may withdraw within 14 days of delivery without penalty and without stating a reason. As a voluntary commercial policy, we extend this period to 30 days from delivery and pay the direct cost of returning the goods.

The procedure, the required condition of the goods, refund times and methods, and the exclusions are set out on the returns and refunds page, which is an integral part of these terms.

10. Legal guarantee of conformity

When the Buyer is a Consumer, every product is covered by the legal guarantee of conformity provided by European Union consumer law. The Seller is responsible for any lack of conformity that exists at delivery and becomes apparent within two years.

When a defect is reported, we explain how repair or replacement works and, if needed, arrange a courier collection at our expense. If, after examination, the defect is confirmed, we repair or replace the product at our expense within 30 days of receiving it. If it is not confirmed, we inform you promptly and the product can be collected at your expense within 30 days. The action for hidden defects is time-barred twenty-six months after delivery.

11. Liability

The Seller answers, within the limits of the law, for damage caused by its own breach of this contract. The Seller does not answer for circumstances it cannot reasonably control, for products used in ways their instructions or purpose do not allow, or for damage due to alterations carried out after delivery. This clause does not exclude any liability that the law makes mandatory, such as liability for negligently causing death or injury.

12. Prohibited behaviour

The following allow us to refuse or cancel orders under section 5:

  • ordering with false or incomplete details, or with someone else’s details without their permission;
  • refusing cash on delivery parcels repeatedly without warning or a valid reason;
  • placing orders that are unusual in quantity or frequency, or that breach the rules of a promotion;
  • reselling products offered on the Website for personal use;
  • any attempt to compromise the operation or security of the Website.

13. Privacy

The personal data you give us when ordering are processed as explained in the privacy policy. Cookies and similar technologies are covered by the cookie policy.

14. Governing law and disputes

Italian law governs these terms. If you are a Consumer resident in another EU country, you still benefit from the consumer rules of that country that cannot be waived by contract, and you may bring a claim before its courts whenever the law allows it.

We prefer to settle complaints directly: write to our support team and explain what went wrong. Consumers can also use the European Commission’s online dispute resolution platform or the alternative dispute resolution bodies of their country.

15. Amendments

We may amend these terms following changes in the law or in our way of operating. Your purchase is governed by the version published on the Website at the time you place the order.
